TERMS & CONDITIONS

1. Introduction

1.1 These terms and conditions (Terms) govern your use of:

- our website and any related websites or URLs;
- our social media pages and profiles; and
- any services we provide through them, including purchasing entries or memberships, accessing content, and participating in giveaways, or competitions.

(collectively, the Services).
1.2 By accessing or using the Services (including by purchasing an Entry Package or membership, or entering a giveaway), you agree to be bound by these Terms.
1.3 The Services are provided by Deck Drops (ABN 23 961 629 731) (Deck Drops, we, us, our), and these Terms form a binding agreement between you and Deck Drops.
1.4 By accessing or using the Services, you warrant that:

- you have read, understood and agree to be bound by these Terms;
- you are at least 18 years of age; and
- you have the legal capacity and authority to enter into a binding agreement with us.
1.5 Our Privacy Policy, and any other policies or terms referred to on the Services, are incorporated into and form part of these Terms.
2. Entry Packages, Memberships and Accounts
2.1 We may offer:

- one-off entry packages (for example, Bronze / Silver / Gold / Platinum tiers) which give you a specified number of entries into a particular promotion or access period (Entry Packages); and
- from time to time, ongoing memberships or subscriptions that provide continuing benefits such as discounted entries, exclusive content or automatic entries into future promotions (Memberships).
2.2 Details of each Entry Package or Membership (including inclusions, number of entries, price and duration) are shown at checkout or on the relevant promotion page. The inclusions for each package or tier may vary between promotions.
2.3 To purchase an Entry Package or Membership, you may be required to create an account with us and provide accurate, current and complete information. You are responsible for maintaining the confidentiality and security of your login details.
2.4 You may not share your account with any other person. You are responsible for all activity that occurs under your account.
3. Pricing and Payment
3.1 All prices are in Australian dollars (AUD) and, unless stated otherwise, are inclusive of GST . Any applicable payment processing or delivery charges will be shown at checkout.
3.2 You are responsible for any taxes, duties or charges imposed by government or regulatory authorities in connection with your purchase.
3.3 We may change the prices of Entry Packages or Memberships at any time. For subscriptions, we will notify you in advance of any price increase that affects your next billing cycle, and you may cancel before the increase takes effect.
4. Subscriptions – Billing and Cancellation
4.1 If you purchase a recurring Membership (Subscription), you authorise us (or our payment provider) to automatically debit the relevant fees (Subscription Fees) from your nominated payment method at the frequency stated at checkout (e.g. monthly).
4.2 You may cancel your Subscription at any time at least two (2) business days before your next billing date via your account settings (or by any other method we make available).
4.3 If you cancel, your Membership benefits will continue until the end of your then-current billing period, and will not renew. Except as required by the Australian Consumer Law,
Subscription Fees already paid are non-refundable.
4.4 If we fail to provide the Membership in accordance with the Australian Consumer Law, you may be entitled to a remedy, which may include repair, replacement, re-supply or a refund (depending on the nature of the failure).
5. Giveaways and Competitions
5.1 From time to time, we run promotions, giveaways, competitions or random draws (collectively, Competitions) to promote Deck Drops. These may be open to customers who purchase Entry Packages, subscriptions or other goods or services, or who complete specific actions described on the promotion page.
5.2 Each Competition will be subject to its own Promotion Terms which will be displayed on the relevant promotion page (for example, on our website or social media). The Promotion
Terms will set out key details such as:
- eligibility (e.g. age and residency);
- opening and closing dates for entries;
- how to enter and number of entries per Entry Package or Membership;
- prize details and approximate retail value; and
- how and when winners will be drawn and notified.
5.3 By entering a Competition, you agree to be bound by the Promotion Terms and these Terms. If there is any inconsistency, the Promotion Terms prevail for that Competition.
5.4 Unless expressly stated otherwise in the Promotion Terms:

- entry into Competitions is only open to Australian residents aged 18 years or over; and
- winners are selected at random using a fair and transparent method (for example, a certified electronic random draw system); and
- the total prize pool for any single Competition will not exceed AUD $10,000.
5.5 You acknowledge that we may operate Competitions in various Australian states and territories. We will conduct Competitions in accordance with applicable laws, including any conditions of conduct (for example, requirements relating to random draws, record-keeping and notification of winners). However, we do not warrant that any Competition will be available in every state or territory.
5.6 We reserve the right to amend, suspend, delay or cancel a Competition if:

- events beyond our reasonable control make it impossible or impracticable to
proceed; or
- we reasonably believe the Competition has been subject to fraud, tampering or other misconduct.
5.7 If you are selected as a winner, you consent to us using your name, suburb, likeness, voice and image (including photographs or video) in connection with marketing and promotional materials (including on our website, email and social media) without additional payment, except where prohibited by law.6. Orders for Goods (if applicable)
6.1 We may sell physical goods or digital products through the Services (Goods). Your purchase of Goods is subject to these Terms.
6.2 An order is accepted when you submit the order, full payment is received, and we issue an order confirmation.
6.3 Orders cannot be cancelled except as required by the Australian Consumer Law or with our consent.
6.4 We may cancel an order in whole or in part if Goods are unavailable, pricing errors occur, fraud is suspected, or we cannot fulfil the order. Refunds will be provided where applicable.
7. Your Information and Billing
7.1 You must ensure all information you provide is accurate and kept up to date.
7.2 If your payment method fails, is cancelled or compromised, you must update it promptly.
7.3 We may correct billing errors and issue refunds or re-charges where necessary.
8. Intellectual Property

All content in the Services is owned by or licensed to Deck Drops. You receive a limited licence for personal, non-commercial use only.
9. Privacy

We collect and use personal information in accordance with our Privacy Policy.
10. Unauthorised Access & Security

You must not misuse the Services or introduce harmful code.
11. Third-Party Links

We are not responsible for third-party sites, services or content.
12. Limitation of Liability

Our liability is limited to the maximum extent allowed by law. Where it cannot be excluded, remedies are limited to repair, replacement or refund as appropriate.13. Release & Indemnity

You indemnify Deck Drops against losses arising from your use of the Services or breach of these Terms.
14. Changes

We may update the Services or these Terms at any time. Continued use constitutes acceptance.
15. Termination

We may suspend or terminate access for breach or misconduct. We may also terminate on 30 days’ notice.
16. General

Standard contract boilerplate (waiver, severability, force majeure, entire agreement).
17. Governing Law

These Terms are governed by NSW law, and disputes are submitted to NSW courts.
